1. Background

1.1. Health and Longevity Optimisation Limited (“Hooke”) is a leading service provider in the healthcare sector providing clients with health assessments and longevity programmes utilising a number of limbs including medical, fitness, nutritional and cognitive elements.

1.2. Any reference to “Hooke” in these terms and conditions shall include its employees and authorised agents.

1.3. Hooke Fitness is a fitness facility operated by Hooke situated at 86 Brooke Street, London W1K 5AY (“Hooke Fitness”).

2. Limitation of liability

2.1. I agree that:
(a) any personal property belonging to myself or any guests I bring (each a “User”) is brought onto the Premises at the Users’ own risk. Hooke shall not be liable for any loss, damage, or theft of personal property occurring on the Premises. 
(b) Users shall use the facilities at Hooke Fitness at their own risk. Hooke shall not be responsible for any injury, occurring upon the Premises or as a result of the use of facilities, food, beverage, supplements and/or equipment provided by Hooke and I hereby release Hooke Fitness, its owners, employees, and contractors from any and all liability for injuries, damages, or losses that may arise from my participation in activities, use of equipment, or presence at Hooke Fitness save that nothing in these terms shall seek to limit any liability for personal injury that arises from any negligent act or negligent omission of Hooke.

3. Physical condition of Client 

3.1. I acknowledge and agree that:

(a) there is risk of injury associated with participation in fitness, exercise or sports activities and shall use the facilities with due care.

(b)I will be responsible for using the facilities safely and in accordance with any usage guidelines either on the equipment or otherwise provided by Hooke.

(c) incorrect or inappropriate use of the facilities within Hooke Fitness can result in serious harm to myself and others.

(d) it is my responsibility to seek medical advice in relation to any medical, physical, and psychological concerns that might prevent safe use of the facilities at Hooke Fitness. 

3.2. I confirm that they are suitably physically fit and mentally capable of operating any equipment they choose to operate and engaging in active or passive exercise and that exercise would not be detrimental to their health, safety, comfort, or physical condition and are not taking any medication that may prohibit them from operating the facilities.

3.3. I certify that I am in a sufficient physical and mental state to participate in hot and cold therapy and have not been advised against doing so by a medical professional. I am aware of the potential risks associated with extreme temperatures such as sauna and cold water and I am participating of my own accord.

4. Hours of opening

4.1. Normal hours of operation are available to Clients can be obtained upon request or from the website.

4.2. Hooke Fitness reserves the right to vary its opening times. In addition, Hooke Fitness has the right at any time to close any or all of the facilities for the purpose of cleaning, building, decorating, repairs or special functions. During bank and public holidays special hours apply and these can be obtained upon request or from the Hooke Fitness website.

5. Facilities

5.1. Hooke Fitness retains the right to vary, add or eliminate any of the particular services and facilities provided, including treatment/therapy sessions and personal trainers.

5.2. Only Personal Trainers that are a part of Hooke Fitness may be used in the gym.

6. Lost Property

6.1. Without prejudice to clause 2 above, all lost property will be recorded in the lost property logbook and kept in a secure place. 

6.2. Personal Items including clothes, shoes, gym equipment and toiletries will be stored for a minimum of 1 month. 

6.3. Valuable items including phones, jewellery, glasses, and watches will be stored for a minimum of 3 months. After this time personal items will be donated to charity.

7. Booking & cancellation policy

7.1. Hooke recommends booking personal training and therapy/recovery sessions in advance to secure preferred date(s) and time(s).

7.2. My appointment is confirmed when I receive a booking confirmation email or message from Hooke.

7.3. I acknowledge that: 

(a) It will be my responsibility to ensure I attend each session at the agreed time and place. 

(b) If I need to reschedule or cancel a session, I will do so on not less than 24 hours’ notice and Hooke will endeavour to provide alternative available slots. 

(c) If I cancel any session (including personal training, therapy, and recovery sessions) on less than 24 hours’ notice or I do not attend the session for any reason, the price paid for such session will be retained by Hooke and shall be non-refundable. 

(d) Late arrival to sessions may result in a shortened session.

7.4. Where Hooke offers session block bookings, Hooke will confirm the price for the block booking (and any applicable discount to single session rates) together with the period during which the sessions must be taken (“Block Booking Period”). Clauses 7.1 – 7.3 shall apply to each individual session. I acknowledge that it will be my responsibility to book and attend all block booked sessions within the Block Booking Period. Subject to clause 7.5 I acknowledge I cannot cancel or amend my block booking and fees for the block booking will be non-refundable.

7.5. Hooke may permit a partial refund (equal to the price of any unused sessions less any reasonable administrative or banking charges incurred by Hooke) following the cancellation of a block booking prior to the end of a Block Booking Period in the following exceptional circumstances:

(a) I suffer a long-term illness or injury (excluding any illnesses or injuries Hooke and/or I were aware of prior to the block booking) and training/therapy is against medical advice.

(b) I become pregnant and training/therapy is against medical advice.

(c) I have a change in my principal place of work or home that makes attendance at future sessions impractical

Hooke reserves the right to request reasonable evidence of the exceptional circumstance and the decision as to whether the block booking can be cancelled shall remain at Hooke’s discretion.  

8. Payments

8.1. All payments for individual sessions or block bookings are to be made in advance via the Midbody app. However, Hooke accept credit/debit cards, and this may be made in person.

8.2. Hooke’s prices are subject to change without notice. The pricing for specific treatments and services are available on Hooke’s website or price list in the gym.

9. Privacy

9.1. Hooke respect its client’s privacy and will handle personal information in accordance with applicable data protection laws.

9.2. I confirm I have read and understood Hooke’s Privacy Policy.

10. Changes to Terms and Conditions

10.1. Hooke reserves the right to update or modify these terms and conditions at any time. I confirm I will check Hooke’s website or inquire at Hooke Fitness for the most recent version.

10.2. By using Hooke’s services, I acknowledge that I have read, understood, and agreed to these terms and conditions.
